Na exposição que se apresenta, definimos o conceito de política à luz de “O 18 de Brumário de Luís Bonaparte”, do qual Marx assinalou uma leitura específica sobre a história. Este trabajo investiga las interrelaciones entre la regulación y los as-pectos económicos y ambientales en una comunidad de agricultores familiares en la región conocida como Zona da Mata Mineira, en el estado brasileño de Minas Gerais. El estudio es producto de una acti-vidad de extensión realizada entre 2016 y 2018, y tuvo como objetivo asesorar a los pequeños productores en el proceso de adecuación legal de la producción. Durante este período se realizaron cerca de cinco reuniones entre investigadores y comuneros, (...) en las que se analizaron las dificultades encontradas por los pequeños productores en relación con el referido proceso. Las experiencias reportadas fueron confron-tadas con el régimen legal regulatorio para la actividad acuícola en Brasil, tomando como categorías de análisis los atributos de norma-tividad y facticidad del sistema legal. Se concluyó que la regulación ambiental en el área de la acuicultura en Brasil, diseñada para grandes productores, carga de manera desproporcionada a los pequeños pro-ductores, generando un desequilibrio económico injustificado. Como aporte a la teoría, se propone, en definitiva, la formulación de un con-cepto de regulación jurídica inclusiva, cuyos rasgos distintivos inclu-yen la participación social y la promoción de la alfabetización jurídica como derecho fundamental. ABSTRACT The presence of truth and honesty is a permanent demand, and becomes vital the more committed and intimate a relationship is. Medical practice is relevant to this discussion when one questions whether or not a physician should always tell their patient the truth in the face of a progressive or potentially fatal disease, regarding the diagnosis, outcome, therapy and evolution of the specific disease. From this discussion we aim, with the present report, to look at the truth applicable to (...) the patient‐physician relationship, and its ethical and moral implications; and also to look at where the Brazilian Code of Medical Ethics (BCME) and the medical literature stand regarding this issue. One concludes that there are only two moments not to tell a patient the truth: when the patient does not want to be informed, and when the truth could be iatrogenic. The question now is, when would the truth be iatrogenic? Physicians, in our opinion, would not be able to judge solitarily when the truth might be deleterious to their patient. Alternatively, we propose the appointment of a multidisciplinary commission to help the doctor with such a decision. (shrink)

A digressão critica a produção, por parte de Dionísio, jovem tirano de Siracusa, de um tratado sobre a filosofia platônica, visando suas ‘doutrinas’, como se já soubesse tudo sobre os princípios supremos da realidade. La reconocida autoridad de los firmantes y la extensión temática que (...) abarcan constituyen este volumen en una nueva obra de referencia necesaria para los estudios dionisianos y de las recepciones del pensamiento tardo-antiguo en general. O autor analisa a posição de Antero de Quental perante o movimento iberista do século XIX, destacando a origem peninsular deste e a sua tradição, com raízes no liberalismo. Aponta a influência nesse movimento de um proudhonismo ingénuo, e destaca o papel de José Félix Henriques Nogueira como transmissor de um ideal federativo com base na concepção de uma "pátria espanhola comum", em que a federação tende no limite paraa fusão.A propósito conclui que a formulação dada por Antero a este (...) pensamento, em Portugal perante a Revolução de Espanha não é mais radical que a de Nogueira, antes é uma consequência contida no pensamento deste precursor do republicanismo. Por outro lado, Teófilo Braga, além de partilhar do ideal liberalista, advogou a separação dos Açores do continente português, contrariamente a Antero de Quental, que pensava que os açorianos só podiam ser portugueses, devendo entrar, federados com o Continente, num estado ibérico. /// L'auteur analyse la position de Antero de Quental devant le mouvement ibériste du XlX.e siècle, en mettant en relief son origine péninsulaire et sa tradition enracinée dans le libéralisme portugais. This brief review of Mario Bunge’s research on physics begins with an analysis of his masterpiece Foundations of Physics, and then it discusses his other contributions to the philosophy of physics. Following that is a summary of his more recent reactions to scientific discoveries in physics and a discussion of his position about non-locality in quantum mechanics, as well as his changing opinions on the nature of spacetime. The eliminative view of gauge degrees of freedom—the view that they arise solely from descriptive redundancy and are therefore eliminable from the theory—is a lively topic of debate in the philosophy of physics. Recent work attempts to leverage properties of the QCD $$\theta _{\text {YM}}$$ θ YM -term to provide a novel argument against the eliminative view. The argument is based on the claim that the QCD $$\theta _{\text {YM}}$$ θ YM -term changes under “large” gauge transformations. Here we review (...) geometrical propositions about fiber bundles that unequivocally falsify these claims: the $$\theta _{\text {YM}}$$ θ YM -term encodes topological features of the fiber bundle used to represent gauge degrees of freedom, but it is fully gauge-invariant. Nonetheless, within the essentially classical viewpoint pursued here, the physical role of the $$\theta _{\text {YM}}$$ θ YM -term shows the physical importance of bundle topology (or superpositions thereof) and thus counts against (a naive) eliminativism. In this paper, we propose Kripke-style models for the logics of evidence and truth LETJ and LETF. These logics extend, respectively, Nelson’s logic N4 and the logic of first-degree entailment with a classicality operator ∘ that recovers classical logic for formulas in its scope. According to the intended interpretation here proposed, these models represent a database that receives information as time passes, and such information can be positive, negative, non-reliable, or reliable, while a formula ∘A means that the information about (...) A, either positive or negative, is reliable. This proposal is in line with the interpretation of N4 and FDE as information-based logics, but adds to the four scenarios expressed by them two new scenarios: reliable information for the truth and for the falsity of a given proposition. Not all symmetries are on a par. For instance, within Newtonian mechanics, we seem to have a good grasp on the empirical significance of boosts, by applying it to subsystems. This is exemplified by the thought experiment known as Galileo’s ship: the inertial state of motion of a ship is immaterial to how events unfold in the cabin, but is registered in the values of relational quantities such as the distance and velocity of the ship relative to the shore. But (...) the significance of gauge symmetries seems less clear. For example, can gauge transformations in Yang-Mills theory—taken as mere descriptive redundancy—exhibit a similar relational empirical significance as the boosts of Galileo’s ship? This question has been debated in the last fifteen years in philosophy of physics. I will argue that the answer is ‘yes’, but only for a finite subset of gauge transformations, and under special conditions. Under those conditions, we can mathematically identify empirical significance with a failure of supervenience: the state of the Universe is not uniquely determined by the intrinsic state of its isolated subsystems. Empirical significance is therefore encoded in those relations between subsystems that stand apart from their intrinsic states. (shrink)

There are communities in which disadvantaged groups experience severe inequality. For instance, poor and indigent families face many difficulties accessing their social rights. Their condition is largely the consequence of the wrong choices of those in power, either historical or more recent choices. The lack of opportunities of these deprived citizens is due to state omissions. In such communities, it is not unusual for homeless members of these particular groups to occupy abandoned lands and build their shelters there. However, almost (...) everywhere, these actions constitute a crime. The typical response to this situation is prosecution and punishment. In this paper, I will defend the occupation of public places as a consequence of the failure of governments to solve the problem of housing, and I will argue that we must distinguish a social claim from a crime and avoid the use of criminal law in these “occupation cases”. I will also argue that our right—as a community—to blame and punish these “squatters” is eroded by the fact that we perpetrated their situation of injustice. (shrink)

Local gauge theories are in a complicated relationship with boundaries. Whereas fixing the gauge can often shave off unwanted redundancies, the coupling of different bounded regions requires the use of gauge-variant elements. Therefore, coupling is inimical to gauge-fixing, as usually understood. This resistance to gauge-fixing has led some to declare the coupling of subsystems to be the \textit{raison d'\^etre} of gauge \cite{RovelliGauge2013}. Indeed, while gauge-fixing is entirely unproblematic for a single region without boundary, it introduces arbitrary boundary conditions on the (...) gauge degrees of freedom themselves---these conditions lack a physical interpretation when they are not functionals of the original fields. Such arbitrary boundary choices creep into the calculation of charges through Noether's second theorem, muddling the assignment of physical charges to local gauge symmetries. The confusion brewn by gauge at boundaries is well-known, and must be contended with both conceptually and technically. It may seem natural to replace the arbitrary boundary choice with new degrees of freedom, for using such a device we resolve some of these confusions while leaving no gauge-dependence on the computation of Noether charges \cite{DonnellyFreidel}. But, concretely, such boundary degrees of freedom are rather arbitrary---they have no relation to the original field-content of the field theory. How should we conceive of them? Here I will explicate the problems mentioned above and illustrate a possible resolution: in a recent series of papers \cite{GomesRiello2016, GomesRiello2018, GomesHopfRiello} the notion of a connection-form was put forward and implemented in the field-space of gauge theories. Using this tool, a modified version of symplectic geometry---here called `horizontal'---is possible. Independently of boundary conditions, this formalism bestows to each region a physically salient, relational notion of charge: the horizontal Noether charge. Meanwhile, as required, the connection-form mediates an irenic composition of regions, one compatible with the attribution of horizontal Noether charges to each region. Thes aims of this paper are to highlight the boundary issues in the treatment of gauge, and to discuss how gauge theory may be conceptually clarified in light of a resolution to these issues. A literatura chamada de “apocalíptica” tem recebido uma renovada apreciação nos últimos anos. Entretanto, percebe-se certa confusão terminológica que, por fim, leva a uma classificação equivocada do gênero de certos escritos. O presente artigo tem por finalidade analisar as conceituações e as expressões literárias da apocalíptica, com o intuito de se chegar a uma definição mais clara do tema, distinguindo apocalipse enquanto gênero literário e apocalíptica enquanto mentalidade , com as formas básicas de expressão literária do gênero e seus paralelos (...) antigos. Assim sendo, o artigo é dividido em duas partes: primeiramente, verificam-se as definições e características atribuídas ao gênero apocalíptico pelos principais autores do tema, especialmente no que se refere aos escritos judaico-cristãos produzidos entre 250 a.C. e 100 d.C.; em seguida, verificam-se os paralelos antigos presentes na literatura de outros povos, como os sumérios, os persas e os gregos. Por fim, faz-se uma breve análise da ocorrência dessa literatura nos Manuscritos do Mar Morto. Isto posto, chega-se à conclusão de que é possível fazer a distinção acima proposta, a qual traz maior clareza na definição e classificação dos escritos ao gênero atribuídos. (shrink)

Dung’s argumentation frameworks have been applied for over twenty years to the analysis of argument justification. This representation focuses on arguments and the attacks among them, abstracting away from other features like the internal structure of arguments, the nature of utterers, the specifics of the attack relation, etc. The model is highly attractive because it reduces most of the complexities involved in argumentation processes. It can be applied to different settings, like the argument evaluation of an individual agent or the (...) case of dialectic disputes between two agents (pro and con), or even in multi-agent collective argumentation. The latter case involves agents with possibly different arguments and/or opinions on how to evaluate them, leading to the possibility of considering multiple sets of arguments and attack relations. Two basic questions can be asked here, namely ‘what to aggregate’ and ‘how to aggregate’. The former concerns what kinds of entities do the agents intend to choose (arguments, attacks, assessments, etc.), while the second one focuses on which aggregation mechanisms yield rational choices (voting on arguments, merging procedures to obtain a common argumentation framework, deliberation processes, etc.). In particular, the question about the rationality of a collective argument choice relates this topic to Social Choice and Judgment Aggregation theories, while its associated strategic issues relate it to Game Theory. The research efforts on the disparate problems elicited by collective argumentation have generated a considerable corpus of literature that deserves an orderly evaluation. After a brief introduction to issues that plague the realization of a theory of quantum gravity, I suggest that the main one concerns defining superpositions of causal structures. This leads me to a distinction between time and space, to a further degree than that present in the canonical approach to general relativity. With this distinction, one can make sense of superpositions as interference between alternative paths in the relational configuration space of the entire Universe. But the full use of relationalism (...) brings us to a timeless picture of Nature, as it does in the canonical approach. After a discussion of Parmenides and the Eleatics' rejection of time, I show that there is middle ground between their view of absolute timelessness and a view of physics taking place in timeless configuration space. In this middle ground, even though change does not fundamentally exist, the illusion of change can be recovered in a way not permitted by Parmenides. It is recovered through a particular density distribution over configuration space which gives rise to 'records'. Incidentally, this distribution seems to have the potential to dissolve further aspects of the measurement problem that can still be argued to haunt the application of decoherence to Many-Worlds quantum mechanics. I end with a discussion indicating that the conflict between the conclusions of this paper and our view of the continuity of the self may still intuitively bother us. Nonetheless, those conclusions should be no more challenging to our intuition than Derek Parfit's thought experiments on the subject. (shrink)

Why is gauge symmetry so important in modern physics, given that one must eliminate it when interpreting what the theory represents? In this paper we discuss the sense in which gauge symmetry can be fruitfully applied to constrain the space of possible dynamical models in such a way that forces and charges are appropriately coupled. We review the most well-known application of this kind, known as the 'gauge argument' or 'gauge principle', discuss its difficulties, and then reconstruct the gauge argument (...) as a valid theorem in quantum theory. We then present what we take to be a better and more general gauge argument, based on Noether's second theorem in classical Lagrangian field theory, and argue that this provides a more appropriate framework for understanding how gauge symmetry helps to constrain the dynamics of physical theories. Since communication and expression are central aspects of music performance it is important to develop a systematic pedagogy of teaching children and teenagers expressiveness. Although research has been growing in this area a comprehensive literature review that unifies the different approaches to teaching young musicians expressiveness has been lacking. Therefore, the aim of this article is to provide an overview of literature related to teaching and learning of expressiveness from music psychology and music education research in order to build a (...) new theoretical framework for teaching and learning expressive music performance in instrumental music lessons with children and teenagers. The article will start with a brief discussion of interpretation and expression in music performance, before providing an overview of studies that investigated teaching and learning of performance expression in instrumental music education with adults and children. On the foundation of this research a theoretical framework for dialogic teaching and learning of expressive music performance will be proposed and the rationale explained. Dialogic teaching can be useful for scaffolding young musicians’ learning of expressivity as open questions can stimulate thinking about the interpretation and may serve to connect musical ideas to the embodied experience of the learner. A “toolkit” for teaching and learning of expressiveness will be presented for practical application in music lessons. In addition, a theoretical model will be proposed to further our understanding of teaching and learning of expressive music performance as a multifaceted and interactive process that is embedded in the context of tutors’ and learners’ experiences and environment. Finally, implications of this framework and suggestions for future research will be discussed. (shrink)

The problems that arise from the presence of self-attacking ar- guments and odd-length cycles of attack within argumentation frameworks are widely recognized in the literature on defeasible argumentation. This paper introduces two simple semantics to capture different intuitions about what kinds of arguments should become justified in such scenarios. These semantics are modeled upon two extensions of argumentation frameworks, which we call sustainable and tolerant. Each one is constructed on the common ground of the powerful concept of admissibility introduced by (...) Dung in [10]. The novelty of this approach consists in viewing the admissibility of a subset of arguments as relative to potentially challenging subsets of arguments. Both sustainable and tolerant semantics are more credulous than preferred semantics (i.e. they justify at least the same arguments, and possibly more). Given certain sufficient conditions they coincide among them as well as with other semantics introduced by Dung. (shrink)

In this paper we provide a compact presentation of the verisimilitudinarian approach to scientific progress (VS, for short) and defend it against the sustained attack recently mounted by Alexander Bird (2007). Advocated by such authors as Ilkka Niiniluoto and Theo Kuipers, VS is the view that progress can be explained in terms of the increasing verisimilitude (or, equivalently, truthlikeness, or approximation to the truth) of scientific theories. According to Bird, VS overlooks the central issue of the appropriate grounding of scientific (...) beliefs in the evidence, and it is therefore unable (a) to reconstruct in a satisfactory way some hypothetical cases of scientific progress, and (b) to provide an explanation of the aversion to falsity that characterizes scientific practice. We rebut both of these criticisms and argue that they reveal a misunderstanding of some key concepts underlying VS. (shrink)

Through a theoretical examination of the preventive turn in criminal law and justice which has gained momentum in Anglo-American criminal justice systems since the late-twentieth century, The Preventive Turn in Criminal Law demonstrates how recent transformations in criminal law and justiceare intrinsically related to and embedded in the way liberal society and liberal law have been imagined, developed, and conditioned by its social, political, and historical context. This text represents our first attempting to offer a Metaphysic model to interpret the late modernity (which emerges in the middle of the 18th century and goes along until the end of the IIWW) through the concept of Teleontology. Thus, Teleontology means the procedure of the spirit of the late modern age to shift its paradigms from ontology (an investigation about the being as being, in which existence means an attribute) to teleology, in which essence must be conquered and revealed (...) in the final of a progressive process. Instead of Being, Man became the main object of this investigation; the question of the being as being has given way as to an enlightened concept of being-man (never reached) as also to the task to achieve this in order to satisfy what reason designed to human species. However, as this project of achieving the concept of Being-Man advanced, its true nature became clear: a unilateral and arbitrary colonial expansion, which forced everyone to follow Teleontological paradigms. Teleontology can demonstrate that Greek-Christian metaphysics means a particular element (never universal) submitted to a specific culture and, in this case, expresses the structure of Eurocentric thought that became global by way of the expanding of capitalism/colonialism. Specifically, in this text, we propose to investigate: 1 - what is Teleontology; 2 - what are its objects; 3 - what are its origins. (shrink)

This article aims to rethink the meaning of “nature” and the human in Plato, more specifically through some examples contained in the _Phaedrus_, a rare dialogue further away from the city. Phaedrus and Socrates leave Athens on a path outside the walls, past the Ilisus stream and the breeze of the woods, and end up sitting in the shadows of trees full of singing cicadas. What is the meaning of this scenario in the construction o the text? Is it possible (...) to learn from oak trees or insects? The philosophizing of this dialogue passes through the coolness of the shadows of the trees in the hot summer noon. This sensuous topography through the text reveals the writer Plato wary of the enveloping meaning of the living drama between Phaedrus and Socrates. The audience and participation of natural elements, trees and cicadas in the dialogue reveals an involvement of the discourse with the surrounding atmosphere, a special concern of Socrates in his palinode and in his final prayer to Pan. In this dialogue, more than distinct and removed from nature, we think the human being (and reason) immersed in it - in an attempt to integrate a mythological and dialogical search between river, rock, plants, animals, humans, gods and demigods. The image of an overly rationalist and humanist Plato finds in this text a perspective of an inspired writer, a hybrid poet and philosopher, with a mission to restore language and the city to animal and cosmic life. Theory change is a central concern in contemporary epistemology and philosophy of science. In this paper, we investigate the relationships between two ongoing research programs providing formal treatments of theory change: the (post-Popperian) approach to verisimilitude and the AGM theory of belief change. We show that appropriately construed accounts emerging from those two lines of epistemological research do yield convergences relative to a specified kind of theories, here labeled “conjunctive”. We review three broadly geometrodynamical---and in part, Machian or relational---projects, from the perspective of spacetime functionalism. We show how all three are examples of functionalist reduction of the type that was advocated by D. Lewis, and nowadays goes by the label `the Canberra Plan’. The projects are: the recovery of geometrodynamics by Hojman et al. ; the programme of Schuller and collaborators to deduce a metric from the physics of matter fields; the deduction of the ADM Hamiltonian by Gomes and (...) Shyam. We end by drawing a positive corollary about shape dynamics: namely, it has a good rationale for the Hamiltonian it postulates. (shrink)

O presente artigo pretende mostrar por que é que a actualidade de Teilhard de Chardin é hoje imune às vicissitudes dos tempos e a sua obra se transformou num verdadeiro clássico do pensamento cristão no século XX. Mostra-se, com efeito, o valor permanente da mensagem teilhardiana, mensagem esta que importa acolher com entusiasmo renovado no momento em que se comemoram os primeiros 50 anos depois da morte do grande cientista e pensador. Neste sentido, o artigo mostra de que modo a (...) questão de Deus constitui o cerne da visão teilhardiana, já que nela reside o eixo orientador de todo o seu pensamento e actividade. O pensamento de Teilhard de Chardin pode, pois, ser considerado como uma grandiosa tentativa de responder à pergunta que nos nossos dias atravessa a alma dos homens e mulheres que se inserem no âmbito da tradição judaico-cristã, a saber: será possível pensar Deus, crer em Deus, aceitar Deus e agir à luz da existência de Deus num mundo que, aparentemente, chegou ao termo da imensa operação cultural, iniciada dois séculos antes, de liquidar de vez a herança teísta de uma história imemorial? Pergunta decisiva, da qual estão suspensas as próprias razões de viver do homem de hoje e o destino do Cristianismo na civilização por ele em grande parte inspirada. Segundo o artigo, a grandeza de Teilhard de Chardin e o segredo do seu imenso impacto num tempo em que a cultura pós-teísta parecia estabelecer definitivamente os seus próprios títulos de legitimidade histórica, residem não só na lucidez com que o pensador fez face à grande interrogação, mas também na originalidade da resposta que para ela encontrou. /// Aim of this article is primarily to show why the actuality of Teilhard de Chardin is nowadays immune to the vicissitudes proper to the change of times and that his work is now a true classic within the realm of contemporary Christian thought. The essay shows the permanent value of the teilhardian message, which we are particularly invited to grasp as we commemorate the 50 th anniversary after the death of the great scientist and thinker. In this sense, the article shows how the question of God constitutes the core of Teilhard de Chardin's vision and how this question is the organizing factor of his thought and activity. Thus, the thought of Teilhard de Chardin can be considered a grandiose attempt at answering the question that in our time touches so many men and women within the Judaeo-Christian tradition, namely: is it possible to think God, to believe in God, to accept God and to act in the light of God's existence in a world in which the cultural operation that began two centuries ago aimed at finishing up with the theistic heritage of our immemorial history seems to have come full circle? This is certainly a decisive issue in the measure that from it depends the question of meaning for the human being of today's world as well as the destiny of Christianity within the Civilization that has so deeply been inspired by it. According to the article, the greatness of Teilhard de Chardin and the secret of his immense impact in a time in which the posttheistic culture seemed to establish definitely its own titles of historical legitimacy, can be found not only in the lucidity with which the thinker faced the great question, but also in the originality of the answer that he was able to give. The body of Eva in Thomas Aquinas The constitution of the first female body or the body of Eva presents several physical and metaphysical problems, problems that have gone through the centuries and reach the present, generating social and cultural consequences for women. The non-existence of parents demands from Aquino answers that go beyond the anthropological and biological and lead to the search of philosophical answers intertwined with the theological ones. Thomas Aquinas provides rational answers although the background is of (...) faith, and even, with literal interpretations of the Sacred Scriptures now abandoned. The Aquinate makes an intellectual effort to find answers in a rational field because the matter of the body of the first woman brings difficulties for its elucidation and understanding. As in other parts of his extensive work, Thomas Aquinas, follows the biological and physical works of Aristotle. Although the Aristotelian background is in line with Christian thought, Aquinas shows his extraordinary capacity for synthesis between the faith received and reason argued, between revelation and the principles of reason. Micro Credit (MC) programs lend money to poor borrowers using innovative mechanisms such as group lending under joint liability while successfully accounting for the presence of asymmetric information in underdeveloped financial markets. MC programs have achieved what the conventional financial institutions and the government have not been able to: lend to the poor, impressive loan recuperation, and a positive impact in poverty reduction. This article analyzes the performance of ALSOL, an MC program in Chiapas, México, for 2151 participants in urban (...) and rural areas for the time period between July 2000 and July 2001. While loan recuperation is high (95%), administrative costs also remain high. Socially responsible lenders and donors play a key role in providing continuous funding to MC programs and assisting in reducing the level of poverty. (shrink)

This paper questions the notion that states may be justified in denying certain prisoners the right to vote as a means of distancing themselves from particularly grave wrongs. Christopher Bennett has recently defended prisoner disenfranchisement as a fair and deserved retributive punishment for crimes, and Mary Sigler and Andrew Altman have argued in favor of prisoner disenfranchisement as a civil restriction. All three proponents agree that disenfranchisement should be reserved for those guilty of the most serious offenses. I assert that (...) it is inappropriate to treat citizens in this manner and will advocate for the right to vote, whether disenfranchisement is perceived as a form of punishment or as a civil measure. I will present two arguments against disenfranchisement as it impacts both citizens and political community at large. First, it excludes citizens from the democratic arena and restricts the opportunity to reintegrate offenders into the political community. While a criminal sentence is intended to be burdensome, the burden associated with disenfranchisement extends beyond the appropriate penal scope. (shrink)

Con ese propósito, el jurista identifica los diferentes modelos de readaptación social (“readaptación para la moralidad” y “readaptación para la legalidad”), con sus virtudes y críticas. Barbour’s interpretation of Mach’s principle led him to postulate that gravity should be formulated as a dynamical theory of spatial conformal geometry, or in his terminology, “shapes.” Recently, it was shown that the dynamics of General Relativity can indeed be formulated as the dynamics of shapes. This new Shape Dynamics theory, unlike earlier proposals by Barbour and his collaborators, implements local spatial conformal invariance as a gauge symmetry that replaces refoliation invariance in General Relativity. It is the purpose of this (...) paper to answer frequent questions about (new) Shape Dynamics, such as its relation to Poincaré invariance, General Relativity, Constant Mean (extrinsic) Curvature gauge, earlier Shape Dynamics, and finally the conformal approach to the initial value problem of General Relativity. Some of these relations can be clarified by considering a simple model: free electrodynamics and its dual shift symmetric formulation. O texto visa mostrar, a partir das análises do Roberto Schwarz e Georg Lukács, como a análise de lastro marxista autêntico é divergente da leitura meramente sociológica, procurando superar a dualidade “esteticismo x sociologismo”, dois reducionismos anti-dialéticos. Em outros termos, trata-se de expor, dentro de nossos limites, como o autor brasileiro ao buscar a inflexão realista de algumas obras não deixa de debater problemas da especificidade estética, portanto, sem que a vida social explique absolutamente a arte, mas ao mesmo tempo, (...) seja seu substrato indispensável. Para tanto, faremos uma primeira reflexão sobre o decurso lukacsiano (Georg Lukács) onde o autor, referência importante para Schwarz, deslinda a arte através, primeiramente, de posições Idealistas (arte em-si-mesmada) e, logo após, a partir da emergência e redescoberta gradual da ontologia marxiana. In this paper, I provide an extensive examination of the political theory of Thomas Hobbes in order to discuss its relevance to an understanding of contemporary issues and challenges faced by criminal law and criminal justice theory. I start by proposing that a critical analysis of Hobbes’s account of punishment reveals a paradox that not only is fundamental to understanding his model of political society, but also can offer important insights into the preventive turn experienced by advanced liberal legal systems. I then suggest that the main importance of an analysis of Hobbes’s theoretical framework lies in how it reveals an inextricable and problematic link between individual autonomy and political authority in the normative conception of the modern liberal state, grounded on the notion of insecurity. By exploring how legal scholars have recently engaged with aspects of this problematic in criminal law and punishment posed by Hobbes’s work, I argue that the paradox found in punishment is such that it both legitimates the criminal law and undermines its normative aspirations, particularly the possibility of securing individual liberty against the power of the liberal state. Dung’s argumentation frameworks are formalisms widely used to model interaction among arguments. Although their study has been profusely developed in the field of Artificial Intelligence, it is not common to see its treatment among those less connected to computer science within the logical-philosophical community. In this paper we propose to bring to that audience a proof-theory for argument justification based on tableaux, very similar to those the Logic students are familiar with. The tableaux enable to calculate whether an argument or (...) subset of arguments are accepted or rejected in accordance to Dung’s preferred and grounded extension-based semantics. Soundness and completeness results regarding those semantics are provided. (shrink)

In an accompanying paper Gomes, we have put forward an interpretation of quantum mechanics based on a non-relativistic, Lagrangian 3+1 formalism of a closed Universe M, existing on timeless configuration space \ of some field over M. However, not much was said there about the role of locality, which was not assumed. This paper is an attempt to fill that gap. Locality in full can only emerge dynamically, and is not postulated. This new understanding of locality is based solely on (...) the properties of extremal paths in configuration space. I do not demand locality from the start, as it is usually done, but showed conditions under which certain systems exhibit it spontaneously. In this way we recover semi-classical local behavior when regions dynamically decouple from each other, a notion more appropriate for extension into quantum mechanics. The dynamics of a sub-region O within the closed manifold M is independent of its complement, \, if the projection of extremal curves on \ onto the space of extremal curves intrinsic to O is a surjective map. This roughly corresponds to \, where \ is a linear projection. This criterion for locality can be made approximate—an impossible feat had it been already postulated—and it can be applied for theories which do not have hyperbolic equations of motion, and/or no fixed causal structure. When two regions are mutually independent according to the criterion proposed here, the semi-classical path integral kernel factorizes, showing cluster decomposition which is the ultimate aim of a definition of locality. In this paper, we address the problem of truth approximation through theory change, asking whether revising our theories by newly acquired data leads us closer to the truth about a given domain. More particularly, we focus on “nomic conjunctive theories”, i.e., theories expressed as conjunctions of logically independent statements concerning the physical or, more generally, nomic possibilities and impossibilities of the domain under inquiry. We define both a comparative and a quantitative notion of the verisimilitude of such theories, and identify (...) suitable conditions concerning the (partial) correctness of acquired data, under which revising our theories by data leads us closer to “the nomic truth”, construed as the target of scientific inquiry. We conclude by indicating some further developments, generalizations, and open issues arising from our results. (shrink)

ABSTRACT In the 1960s, when Dr. Belding Scribner discovered how to accomplish the process of dialysis in a repeated way, he could not imagine that in solving such a problem others as or more difficult would appear. Given the technological progress and the impossibility of assisting all patients through the most modern methods, the medical doctor often finds himself faced with the moral dilemma of choosing which patient in the waiting list will receive the treatment. This same dilemma is amplified (...) in the case of organ transplants. Professionals, students, professors of the juridical and health fields, and the population in general, were interviewed as a means of documenting the moral concepts and opinions surrounding this problem. In the reality in which we find ourselves, it seems to us that deciding who lives, and the responsibility for all the events that culminate in such decisions, is still a subject left open to discussion. O acontecimento do compreender, enquanto questão-chave do pensamento de Gadamer, também pode ser compreendido como uma fusão de horizontes. Do ponto de vista da hermenêutica filosófica, tal aspecto abre a possibilidade de tematização do âmbito próprio da compreensão como uma experiência filosófica simultaneamente ontológica e prática. Por isso, a descrição do compreender enquanto fusão de horizontes indica o tratamento de traços fundamentais da vida humana que, para Gadamer, encontra afinidades com a retomada da filosofia prática de Aristóteles. Deste modo, pretendemos (...) discutir alguns aspectos da relação entre os conceitos de compreensão e fusão de horizonte a partir da conexão essencial entre hermenêutica filosófica e filosofia prática.: The happening of understanding, as key-issue of Gadamer’s thought, can be also understood like a fusion of horizons. From the point of view of philosophical hermeneutics, this aspect opens the possibility of discussing about the sphere of understanding simultaneously ontological and practice philosophical experience. Therefore, the description of understanding as fusion of horizons indicates the treatment of basic traces of human life that finds affinities with the rehabilitation of practical philosophy of Aristotle. Thus, we intend to discuss some aspects of the relation between the notions of understanding and fusion of horizons from the essential connection between philosophical hermeneutics and practical philosophy. Na abordagem hermenêutica das obras de arte, Gadamer discute a arquitetura como uma das expressões artísticas na qual se pode reconsiderar a relação ontológico-interpretativa com as coisas em geral. Repensando a estrutura representativa própria da experiência hermenêutica das obras de arte, Gadamer introduz a arquitetura como uma expressão artística peculiar, na qual as obras de arte resistem aos posicionamentos estéticos atuais, reinserindo-as na esfera prática da vida. Essa tematização encontra ecos importantes na teoria e prática arquitetônicas, à medida que possibilita (...) uma nova relação com as obras de arquitetura, para além das variáveis estéticas. O presente artigo, portanto, tem como objetivo discutir a experiência hermenêutica da arquitetura como um momento interpretativo decisivo da relação com as obras de arte, explicitando tanto o caráter ontológico-hermenêutico do pensamento de Gadamer quanto o traço hermenêutico das obras de arquitetura. Para isso, partimos de um diálogo estabelecido por Gadamer e dois arquitetos, Jacques Herzog e Pierre de Meuron sobre a essência da arquitetura. A resposta gadameriana indicou-nos o horizonte de tematização das obras arquitetônicas como extensão da experiência da obra de arte, tal como foi discutido em Verdade e Método, notadamente na discussão sobre a representação artística e a retomada das noções de ocasional e decorativo. A tematização hermenêutica encontra, por conseguinte, repercussões na teoria e prática arquitetônicas, indicando um horizonte alternativo de questionamento do sentido da arquitetura e urbanismo, situando-o e remetendo-o para o horizonte da vida em comum. A covid-19 tem gerado grande mobilização por parte das sociedades contemporâneas. Como forma de prevenção e controle da doença, o isolamento social tem sido uma medida eficaz, recomendada por diversos órgãos da saúde. Por isso, pensar o isolamento social como prática solidária tem sido fundamental. Nesta perspectiva, o presente artigo busca problematizar o isolamento social enquanto isolamento solidário. Para isso, partimos da tematização da enfermidade, até agora conhecida, seus modos de prevenção e controle e, por conseguinte, o diálogo entre a (...) Saúde Coletiva e a Hermenêutica Filosófica, na tentativa de repensar o isolamento criticamente, para além de uma questão biomédica. Assim, discutir o isolamento solidário como noção essencial ao enfrentamento da pandemia da COVID-19 significa contribuir para uma visão mais ampla de saúde, ao passo que se encontra em jogo o restabelecimento da vida comunitária para além de sua concepção biomédica.
